Organiser

The organiser of SUPER!WEIT is SCHWARZWALD SUPER! e.V. (for address and contact details see Legal Notice). These Terms and Conditions govern the contractual relationship between the organiser and the participants.

§ 1 Eligibility

Participation is open to any person of legal age who has duly registered and holds an official starting place for SUPER!WEIT. Minors aged 16 and over require the accompaniment of a legal guardian to register. Club membership is not required.

§ 2 Obligations

(1) Each participant is responsible for assessing their own health and fitness to participate in SUPER!WEIT, consulting a physician if necessary. Participants must ensure their equipment is in perfect working order and must wear a helmet throughout the ride. The helmet must meet current ANSI/Snell standards, the new TÜV/GS standards, or UCI regulations. Participants must also carry tools and spare parts for the most common repairs.

(2) Participants must comply with the notes and specifications published on the event website (superweit.com) and in the Terms of Participation, as well as with instructions from staff and helpers before, during and after the event. In the event of violations that disrupt the orderly running of the event or may endanger the safety of other participants, the organiser is entitled to exclude the participant concerned from the event at any time.

(3) All notes, instructions and specifications published on the event website (superweit.com) and in the Terms of Participation, as well as those communicated in supplementary participant information (e.g. by newsletter), constitute a direct contractual obligation of the participant. By registering, the participant accepts the Terms of Participation and these Terms and Conditions.

§ 3 Conclusion of Contract

(1) Registration, which constitutes a binding contractual offer from the participant to the organiser, is made via the online registration at superweit.com.

(2) Each participant may register only themselves and only once per event. Duplicate registrations will not be accepted, i.e. a duplicate registration by the same person does not confer a right to a second starting place. Duplicate registration may also lead to exclusion from the event.

(3) The contract is concluded when the participant or their legal guardian has accepted these Terms and Conditions and the Terms of Participation during online registration. The Liability Waiver is acknowledged separately in writing on site before participation. Eligibility to start requires that the registration fee has been received by the organiser and that the participant has received the registration confirmation.

(4) The organising committee may decide at any time whether to accept a registration, or to exclude a registered person from the event if that person may damage the event’s reputation. The organising committee also reserves the right at any time to exclude persons from the event and cancel their starting places if there is reasonable suspicion of commercial resale of starting places.

§ 4 Right of Withdrawal / Exclusion of the Right of Withdrawal

Pursuant to § 312g(2) no. 9 of the German Civil Code (BGB), unless otherwise agreed, there is no right of withdrawal for contracts providing services in connection with leisure activities when the contract provides for a specific date or period of performance.

Since the purchase of a starting place constitutes the booking of a date-bound leisure event, the right of withdrawal is excluded.

By ordering a starting place and any additional chargeable services (e.g. transfer or add-on options), a binding contract is concluded which entails an immediate obligation to pay.

§ 5 Payment

Payment is made online via our partner pretix. The available payment methods are displayed during the registration process.

§ 6 Accreditation

(1) Participants receive their race materials upon registration on site by presenting the official registration confirmation and an ID card or passport. If a participant is unable to attend, they must ensure that the race materials are collected by a person with written authorisation. Race materials can only be collected by persons who can identify themselves as authorised. We regret that we cannot send the race materials by post.

(2) If a participant has lost the official registration confirmation or is otherwise unable to present it, a replacement confirmation will be issued.

(3) Each participant is obliged to check the race materials received at registration for completeness immediately upon receipt. Later complaints cannot be considered.

(4) At accreditation, each participant receives a GPS tracker, which must be carried and kept active for the duration of the event (details see Terms of Participation). A deposit of [X] € is required for issuance. The deposit is refunded in full upon proper return of the tracker; the return modalities are governed by the Terms of Participation. In case of permanent non-return, damage or loss, the deposit is forfeited in favour of the organiser.

§ 7 Cancellation / Distance Change / Transfer of Place

(1) Participants may add a cancellation option to their registration. This is offered for a fee of 20 €. Any additional booked services are excluded from the cancellation option. In the event of cancellation, a refund of the participation fee is issued exclusively by the organiser. The cancellation option may be exercised without reason until 31 July 2026. After that date, a written explanation is required (illness incl. Covid-19, injury or accident etc.). For cancellations from 1 August 2026, the starting place may be transferred to 2027. The cancellation option is exercised in writing by email to hallo@superweit.com.

(2) Cancellation with refund of the registration fee is not possible without an active cancellation option. In justified exceptional cases, a transfer of the starting place to the following year may be granted. This option is available up to one week before the event and must be requested in writing by email to hallo@superweit.com.

(3) Subsequent distance changes are possible. The organiser reserves the right, in the event of bad weather or other unforeseen circumstances, to shorten the route and adjust the time limit. In case of danger, a cancellation or interruption by the authorities is also possible.

(4) The organisers have the right to exclude participants from the event who behave improperly in any way (e.g. in breach of the Terms and Conditions, the Terms of Participation or the rules of conduct).

(5) The organisers may also remove participants from the event who are clearly no longer able to pass the following checkpoints within the time limit. After consultation and at the organiser’s discretion, participants may alternatively continue on their own responsibility and without time recording.

(6) Transfer of a starting place to another person is possible free of charge until the race materials are issued. Any cancellation option already purchased is transferred to the person taking over. The transfer must be requested in writing by email to hallo@superweit.com; by taking over, the new participant accepts these Terms and Conditions and the other event rules.

FLINTA* starting places may only be transferred to other FLINTA* persons (women and non-binary persons).

§ 8 Cancellation of the Event / No-Show

(1) In the event of cancellation of the event due to force majeure (war, pandemic, natural disasters or comparable events), official order or safety reasons, participants have no claim to damages (e.g. for travel costs).

(2) In the case of cancellation pursuant to paragraph 1, the starting place is primarily transferred to the event in the following year. Alternatively, participants may claim a proportional refund amounting to 50 % of the participation fee; the choice must be communicated in writing to hallo@superweit.com within a period set by the organiser. Any cancellation option already purchased is treated analogously: in case of transfer to the following year it remains valid; in case of refund, it is also refunded at 50 %.

(3) If participants are unable to take part in the following year, there is no claim to a refund of the participation fee or the cancellation option.

(4) In the case of a no-show, any claim against the organiser lapses. Claims arising from the cancellation option remain unaffected.

§ 9 Liability

(1) Participation is at the participant’s own risk and constitutes a private bicycle ride. By registering, the participant expressly declares that they are aware of the specific risks of a long-distance bicycle ride.

(2) The organiser’s liability – including towards third parties – for all damages not arising from injury to life, body or health is limited to intent and gross negligence. This also applies to vicarious agents engaged by the organiser. The organiser’s liability is limited to the start and finish area and the two official checkpoints.

(3) The organiser accepts no liability for lost clothing, valuables or equipment belonging to participants. Participants should ensure these items are adequately insured.

(4) Upon receipt of the race materials, the participant bindingly declares that there are no health concerns regarding their participation.

§ 10 Data Collection and Use

(1) The personal data provided by participants at registration is stored and processed solely for the purposes of running and administering the event.

(2) Participants consent that the relevant data provided at registration may be collected by, or passed to, third parties for the purpose of photo search.

(3) Participants consent that the data collected under paragraph 2, as well as their name and starting number, may be published on the event website and on the website of the official photo partner.

(4) Participants consent that photos, film recordings and interviews taken in connection with the event may be published on event media without claim to compensation. The organiser does not sell these photos to third parties.

(5) Participants consent that their data may be used for event-related mailings.

§ 11 Changes

The organiser reserves the right to make programme changes. All official changes and announcements will be communicated on our website superweit.com. Any changes will also be posted at the information boards during race kit collection. These notices are ultimately binding and authoritative.

§ 12 Applicable Law

These Terms and Conditions and all legal relations between the organiser and the participants are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

§ 13 Severability

Should individual provisions of these Terms and Conditions be or become wholly or partly invalid or unenforceable, this shall not affect the validity of the remaining provisions. Invalid or unenforceable provisions shall be replaced by the applicable statutory rules.
